Terms and conditions of sale for online ordering

1 Delivery policy:

Catercycle holds no responsibility or is liable, for any compensation in case of deviations from the indicated delivery times.

All items are priced for Collection from our warehouse. 

Email or phone support is available during normal office hours.

We do not accept responsibility if the machine cannot fit through doors. It is the customer’s responsibility to check if the unit will fit.

If you opt for delivery:-

  • The driver will make one delivery attempt. If the customer is not there, the customer will incur additional delivery costs for any future attempts to deliver the product.
  • Delivery of machines will be to the ground floor only & does not include negotiating rough terrain, steps, stairs, or a lift.
  • If the delivery cannot be completed it is the responsibility of the customer.

2 Shipping Costs:

All orders over the value of €1000 is eligible for free shipping on the Island of Ireland.

Orders under this value will be subject to a delivery charge

3.1 Installation and user manual:

The customer is responsible for the proper installation and proper use of purchased items.

3.2 Product Information:

We encourage and advise our customers to verify the product conditions up to their satisfaction before purchase. This can be done by reading the description, and viewing our provided images, and videos from this website. All units on sale have pictures and, wherever required, a demo YouTube video in their description. We expect the buyer/s to read and watch those visuals meticulously. This information is provided & considered as final for the purchase decision. 

4 Warranty policy:

4.1 All used units supplied by Catercycle have 3-month warranty on Parts & Labour. This warranty is ‘Off Site’

‘Off Site’ warranty covers the below:-

  • In the event of a possible warranty issue, you can bring the item to our service center on the Malahide Road for assessment and/or repair. The item will also need to be collected on completion of the works.
  • In the event of an issue with the item covered under the warranty which is deemed unfixable or not worth fixing. Catercycle will condemn the item and issue a refund of the original cost less 25% to the customer. The decision on this will be made by Catercycle only.

4.4 The warranty covers faultiness due to defective materials or manufacturing flaws. The warranty excludes consumable items such as door seals, air and water filters, bulbs, glass, and infrared elements.

4.5 The warranty covers are limited to the repair or replacement, including labor charges of defective parts. The seller reserves the right to the complete replacement of equipment.

4.6 Warranty work would be carried out during normal working hours MONDAY TO FRIDAY 8 AM – 5.30 PM. This does not include Bank Holidays or Weekends.

4.9 The warranty does not cover any economic loss, profit loss, or any indirect, consequential loss that occurred. The supplier or the manufacturer is not liable to compensate any of the loss apart from repairing the item under warranty terms.

5 The warranty is Null and void if:

  • In case of improper use, mishandling, or not installing as per any installation instruction.
  • Service work is undertaken by an unqualified or unauthorized person.
  • Repairs are made by using components not supplied or authorized by the manufacturer or seller.
  • In case of denial of the right to inspect equipment subjected to frequent failures and excessive warranty claims
  • Abusive (verbal or threatening) behavior by the customer
  • Equipment not paid for within the terms and conditions of the supply
  • The seller reserves the right to void labour warranty to the equipment sold outside Ireland and may charge thereof.

6 No Return policy:

All sales are final

As per usual market practice in the second-hand/refurbished sale business, Catercycle does not offer a return policy for any reason other than what is mentioned in paragraph 4.1 above. Therefore customers are requested to buy at their discretion

7 WEEE:

Catercycle Ireland is committed to meeting the requirements of the European Union (Waste Electrical and Electronic Equipment) Regulations 2014. These Regulations require producers of electrical and electronic equipment to finance the takeback of WEEE resulting from products that we place on the Irish market. This helps us to ensure that WEEE is reused or recycled safely. In line with that commitment, Catercycle Ireland will take back WEEE from you free of charge.

You also have a role to play in ensuring that WEEE is reused and recycled safely. So, if you choose not to return WEEE to us then you should not dispose of it in your bin. The crossed-out wheeled bin symbol on the product reminds users not to dispose of WEEE in the bin. You should ensure that the WEEE is collected separately and sent for proper treatment. WEEE contains hazardous substances and if not managed and treated safely it can cause pollution and damage human health.

7 Modification of Terms:

The terms and conditions are subject to change at any time without any prior notice. Changed terms will become effective once posted on the Website, and will not have any retrospective effect on existing contractual arrangements made through this Website. Your continued use of this Website after any change means you have accepted the changed terms and conditions.

8 Indemnity: 

As a condition of use of this Website, you agree to indemnify us from and against any and all liabilities, expenses (including attorney’s fees), and damages arising out of claims resulting from your use of this Website, including without limitation any claims alleging facts that if true would constitute a breach by you of these terms and conditions.

9 Indemnity on the use of products purchased from our company:

All the products and their features are indicated by the manufacturers and mentioned on our website as per their guidelines and specifications.

The company holds no responsibility in case of any deviation of product or features as stated before or after the purchase of the product if so occurred.

Catercycle holds compensations and losses limited to the price of sales goods only provided all the terms and conditions were followed as stated on the company website. 

The company is liable to service, fix, repair, or get repaired the products sold by themselves and are under warranty.

In no case company is liable to compensate or replace the faulty item if it is repairable, however, the company out rightly rejects its liability and holds no responsibilities in any form in case of loss or void of warranty occurred due to lapse of time or mishandling.

This Website may contain links and pointers to Internet sites maintained by third parties.

We do not operate or control in any respect any information, products, or services on such third-party sites.

Third-party links and pointers are included solely for your convenience and do not constitute any endorsement by us. You assume sole responsibility for use of third-party links and pointers.

11 Limitations on Use:

You agree to use this Website solely to determine the availability of goods and services and make legitimate reservations or transact business with us. Also, you agree to use the Website only for personal, non-commercial use. You agree to use the Website’s services to make only legitimate purchases. You agree to all of our terms and conditions of purchase which include but are not limited to, full and timely payment of all amounts due and compliance with all rules concerning the availability of products, or services. All fees, assessments, charges, taxes, and duties arising out of the use of the Website are your sole responsibility.

12 Jurisdiction Governing Law and Venue:

Any civil action or legal proceeding arising out of or relating to this Agreement shall be brought only in the courts of record of County Dublin only in the Republic of Ireland .

As the company comes under the jurisdiction of Ireland, for all matters relating to the Company/Catercycle.ie website interpretation and fulfillment of the sales, purchase, or thereof, the parties hereto expressly and irrevocably submit to the applicable laws of the Republic of Ireland only, and to the jurisdiction of the competent courts sitting in Dublin City Council, County Dublin, Ireland. With respect to any action or proceeding arising out of or relating hereto, and the parties including seller, buyer, or Consumer including third-party consumers hereby expressly and irrevocably waive all rights to any other jurisdiction to which they may be entitled to by reason of their present or future domiciles, or by any other reason. Jurisdiction, Venue, and Service of Process Any legal action or proceeding, or Arbitration with respect to this Agreement will be brought in the courts, or consumer redressal system of Dublin, Ireland only. By execution and delivery of this Agreement, each of the parties hereto accepts for itself and in respect of its property, generally and unconditionally, the exclusive jurisdiction of the aforesaid courts.
